RENTAL CAR FOLLOWING ACCIDENT

QUESTION: DOES THE INSURANCE COMPANY HAVE TO GIVE ME A RENTAL CAR?

BASIC RULE: When the other driver is clearly at fault, THE INSURANCE COMPANY IS REQUIRED TO PROVIDE YOU A SUBSTITUTE VEHICLE (rental car) immediately following a collision which damages your vehicle and requires that it be repaired.

EXCEPTIONS: IF YOUR CAR IS A TOTAL LOSS, the insurance company is not required to provide a substitute or rental vehicle, BUT they should promptly pay you the value of your vehicle so you can get another vehicle quickly.

QUESTION: WHAT IF I DON'T NEED A RENTAL CAR?

BASIC RULE: If you are entitled to a rental car, but don't get one, then you are entitled to be paid money for the time your vehicle is being repaired. The amount of money is based on the number of days it takes to get your vehicle repaired and the "rental value" of a vehicle like yours.

QUESTION: WILL MY OWN INSURANCE COMPANY PROVIDE ME A RENTAL CAR?

BASIC RULE: Only if you purchased specific rental car coverage as part of your auto insurance policy.

QUESTION: WILL YOU HELP ME GET A RENTAL CAR?

YES - if you hire the ROLAND BROWN LAW FIRM to represent you in your auto collision claim, one of the services we perform is to assist you in getting the rental car you are entitled to.
